1. Scope and Acceptance

These Terms & Conditions of Use (“T&Cs”) apply to all websites and digital platforms operated by the Luxembourg Institute of Socio-Economic Research (“LISER”), a public establishment (établissement public) established under Luxembourg law, registered with the Luxembourg Trade and Companies Register under number J57, and having its registered office at 11, Porte des Sciences, 4366 Esch-sur-Alzette, Grand Duchy of Luxembourg (“LISER”, “we”, “our”, “us”) including all associated domains and subdomains, such as but not limited to liser.lu, iza.org, wol.iza.org, and any related subdomains operated under LISER’s responsibility.

 

By accessing or using any LISER-operated website(s) and/or digital platform(s), including any information, documents, products, or services made available thereon, you (“user”, “you”, “your”) acknowledge that you have read, understood, and agree to be bound by these T&Cs in their entirety. 

2. Purpose of the Websites and Digital Platforms

LISER-operated websites and digital platforms provide access to academic research, publications, policy-oriented analysis, datasets, institutional information and related services. 

 

All content is made available for academic, research, informational and educational purposes only and does not constitute legal, financial, professional or policy advice.

4. Security and Proper Use

4.1 Access via the internet and user responsibility 

Access to the website and/or digital platforms operated by LISER is provided via the Internet.  

 

Access to and use of the website(s) and/or digital platform(s) operated by LISER is provided free of charge, unless expressly stated otherwise. 

 

Certain sections may require registration or authentication. 

 

Personal data processing, including the use of cookies, is governed exclusively by our Privacy Policy, available at the following website: iza.org/privacy-policy

 

Users acknowledge and accept the inherent risks associated with the use of the Internet, including potential risks relating to data security, confidentiality, and cybersecurity. LISER does not guarantee uninterrupted, secure or error-free availability. 

 

It is the responsibility of each user to take appropriate technical measures to protect their own equipment, systems, data, and software against potential cybersecurity threats, including by maintaining adequate security configurations and up-to-date protection measures. 

 

4.2. Use of User account (where applicable) 

These T&Cs apply to members of the IZA@LISER Network members, affiliated researchers, fellows, contributors, authors, peer reviewers and any other registered users who create and/or use a user account on LISER-operated website(s) and/or digital platform(s). 

 

Where access to certain features requires the creation of a user account, users shall be responsible for maintaining the confidentiality of their login credentials as well as all activities carried out under their account. 

 

These T&Cs are without prejudice to, and shall not replace, any separate authorship agreements, membership agreements, editorial contracts or other specific agreements entered into with LISER. 

 

4.3. Acceptable use 

By accessing or using the website(s) and/or digital platform(s) operated by LISER, you agree to: 

• use them lawfully and in compliance with all applicable laws and regulations; 

• not misuse them for any unlawful, fraudulent, or harmful purpose; 

• not interfere with, disrupt, or attempt to compromise the technical operation, security, or integrity of LISER’s website(s) and/or digital platform(s); 

•not attempt to gain unauthorised access to any restricted areas, servers, systems, or networks; 

• not introduce, transmit, or upload any viruses, malware, or other malicious or technologically harmful material; 

• refrain from any activity that may damage, disable, overburden, impair, or otherwise adversely affect the website(s) and/or digital platform(s) operated by LISER, including their availability for other users. 

 

4.4. No transfer of rights 

Any rights expressly or implicitly granted to users under these T&Cs constitute a limited, non-exclusive, non-transferable right to use the website(s) and/or digital platform(s). Such rights do not constitute a transfer of ownership, intellectual property rights, or any other proprietary rights. 

5. Website & Digital Platform Availability, Modifications & Liability

5.1 Availability & Access 

LISER may, at its sole discretion, modify, update, maintain, upgrade, restrict access to, or temporarily suspend all or part of any website and/or digital platform operated by LISER, with or without notice, including where required for maintenance, security, legal compliance, technical reasons, improvements, operational reasons, or any other reason LISER considers necessary or appropriate. 

 

LISER does not guarantee that its websites and/or digital platforms will be available at all times, uninterrupted, secure, error-free, or free from viruses or other harmful components. 

5.2 Changes to content and services 

LISER may, at any time and at its sole discretion, remove, add, amend, modify, correct, replace, update, discontinue, or enhance any part of the information, content, features, functionality, and/or services made available on or through its websites and/or digital platforms. 

 

LISER may also discontinue any website, digital platform, service, feature, or functionality (in whole or in part) at any time. 

6. Intellectual Property

All content made available on LISER-operated websites and/or digital platforms, including publications, texts, photographs, graphics, logos, design elements and other visual materials, is protected by applicable Luxembourg and European copyright and intellectual property laws. 

 

Unless otherwise indicated: 

• copyright in the publications shall remain vested in  the respective author(s), LISER (where applicable) and/or any other relevant rights holders; 

• the structure, layout, design, trademarks, logos and institutional materials of the websites and digital platforms are owned by or licensed to LISER. 

 

Unless otherwise indicated, institutional visual materials are owned or licensed by LISER. 

 

Users may access and download (where applicable) content for personal, academic and non-commercial purposes only and may cite such content in accordance with applicable law and academic standards. 

 

Any commercial use, systematic extraction, reproduction, redistribution, modification or other reuse of content (in whole or in part) beyond what is expressly permitted requires prior written authorisation from the relevant rights holder and/or LISER, where applicable. 

 

No rights are granted beyond those expressly stated. 

8. Disclaimer

LISER endeavours to ensure that the information made available  on its websites and/or digital platforms is accurate and up to date. However, LISER makes no representations or warranties regarding completeness, accuracy, reliability or availability of content. 

 

Opinions expressed in publications are those of the authors and do not necessarily reflect the views of LISER. 

 

Content is provided on an “as is” and “as available” basis.

9. Limitation of Liability

To the fullest extent permitted by applicable law, LISER shall not be liable for any loss or damage arising from or in connection with: 

• any modification, update, maintenance, suspension, restriction of access, interruption, unavailability, or discontinuation of any website and/or digital platform operated by LISER; and/or 

• any removal, addition, modification, or enhancement of any content, information, features, functionality, and/or services. 

 

In particular, and to the fullest extent permitted by applicable law, LISER shall not be liable for any indirect, incidental, special, or consequential loss or damage, including loss of profit, loss of revenue, loss of business, loss of opportunity, loss of goodwill, or loss of data. 

 

Nothing in these T&Cs shall exclude or limit LISER’s liability in any manner that is not permitted under  applicable Luxembourg law. 

10. Suspension and Termination

Without prejudice to any other rights or remedies available under applicable law, LISER reserves the right, at its sole discretion, to suspend, restrict, or terminate your access to all or part of the website(s) and/or any digital platform(s) operated by LISER, at any time and without prior notice, in particular where: 

• you misuse or breach these T&Cs; 

• LISER reasonably suspects misuse, unlawful activity, fraud, or security threats; 

• such action is necessary for maintenance, technical reasons, or to ensure the security and integrity of the website or digital platform operated by LISER; and/or 

• such action is required to comply with applicable law, a court order, or instructions from a competent authority. 

 

LISER shall have no obligation to notify any third party, including any provider of services, products, or information, of any such suspension, restriction, or termination. 

 

Nothing in this clause shall affect any mandatory rights you may have under applicable Luxembourg law. 

11. Amendments

LISER may update or revise these T&Cs at any time, without prior notice. 

 

The most recent version published on the relevant website shall apply and shall be legally binding. 

 

By continuing to use the website(s) and/or digital platform(s) after the publication of updated T&Cs, you acknowledge and accept the revised terms. 

12. Severability

If any provision of these T&Cs is held to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, such provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, or, if that is not possible, severed from these T&Cs. The remaining provisions shall remain in full force and effect.

13. Force Majeure

LISER shall not be liable for any failure or delay in performing its obligations under these T&Cs where such failure or delay results from an event of force majeure within the meaning of Luxembourg law, including events beyond its reasonable control. 

 

Performance of the affected obligations shall be suspended for the duration of the force majeure event. LISER shall use reasonable efforts to mitigate its effects and resume performance as soon as reasonably practicable. 

14. Governing Law and Jurisdiction

These T&Cs   shall be governed and interpreted in accordance with the laws of the Grand Duchy of Luxembourg. 

 

Any dispute, controversy or claim arising out of or in connection with these T&Cs and/or LISER-operated websites and/or digital platforms which cannot be settled amicably shall fall within the exclusive jurisdiction of the courts of the Luxembourg City.
